Official Rules

THIS CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

Ultimate Challenge tests your ability to correctly predict the results of the National Hockey League playoffs.

1. ORGANIZER

The “ULTIMATE CHALLENGE” fantasy (hereinafter referred to as “Ultimate Challenge”) is organized by and for the benefit of the Fondation du Centre Normand-Léveillé (hereinafter the ”Organizer”).

2. ELIGIBILITY CRITERIA

Any person is eligible to participate in Ultimate Challenge who:

  1. resides in Quebec;
  2. is eighteen years old (18) or over at the time of registration for Ultimate Challenge;
  3. makes a donation to the Fondation du Centre Normand-Léveillé for an amount of twenty-five dollars ($25) for each entry, via the Ultimate Challenge website, whose electronic address is: www.ultimatechallenge.ca (hereinafter referred to as the “Website”);
    and
  4. confirms having read and accepted these Rules.

However, the following persons are excluded from participating in Ultimate Challenge: the employees, agents and representatives of the Organizer, as well as any other stakeholders directly involved in the holding of Ultimate Challenge.

3. DURATION OF ULTIMATE CHALLENGE

Ultimate Challenge will be held in Quebec from February 15th, 2019, at 00:01 ET, until the end of the last playoffs game of the 2018-2019 season of the National Hockey League (hereinafter referred to as the “NHL”).

(hereinafter referred to as the “Duration of Ultimate Challenge”).

4. HOW TO PARTICIPATE

  • Registration/entry

To participate in Ultimate Challenge, any person meeting the Eligibility Criteria may register on the Website no later than one (1) hour prior to the start of the first game in the playoffs of the 2018-2019 NHL season, by filling out the required fields in the Ultimate Challenge entry form in order to create an account (hereinafter referred to as the “Entry Form”), and by carefully indicating their exact contact information, so that the Organizer can contact them if they win a prize. Each participant is responsible for providing an email address, as well as a telephone number where they can be reached during weekdays between 9:00 a.m. and 5:00 p.m.

Participants must comply with the following obligations, failing which the Organizer reserves the right to cancel one or more of their entries; they must:

  • Provide accurate information when completing their profile;
  • Accept and comply with these Rules and Ultimate Challenge’s terms of use;
  • Complete one or multiple Entry Forms;
  • For each entry, make a minimum donation of twenty-five dollars ($25) for the benefit of the Fondation du Centre Normand-Léveillé, as set out in section 2 – “Eligibility Criteria” – of these Rules.

Ultimate Challenge is limited to a total of twenty thousand (20,000) entries, notwithstanding any contrary provision of these Rules.

By participating in Ultimate Challenge, the participant acknowledges that the Prize provider, the developer, and the associates or partners of Ultimate Challenge, are in no way involved in any other manner and cannot, therefore, be held liable for any claim arising from the participant’s participation in Ultimate Challenge.

  • Operation of Ultimate Challenge

As of the time when the sixteen (16) playoff spots have been determined and the playoff bracket is final, until one (1) hour prior to the start of the first game of the playoffs for the 2018-2019 NHL season, each participant must predict, on the Website, the entire playoffs bracket by selecting:

  • the winning team of each of the fifteen (15) playoffs series; and
  • the number of games for the selected winning team to win the serie.

The playoff bracket of the Stanbley Cup consists of fifteen (15) playoffs series, namely:

  • Conference quarter-finals: Eight (8) series;
  • Conference semi-finals: Four (4) series;
  • Conference finals: Two (2) series;
  • Stanley Cup final: One (1) serie.

(hereinafter referred to as the “Playoffs Bracket”).

Participants may change their choices up to one (1) hour prior to the start of the first game of the playoffs for the 2018-2019 NHL season. After this, they will not be able to change their choices.

Participants are solely responsible for entering their choices, as indicated above.

5. DETERMINATION OF WINNER(S)

Only the participant or participants who have successfully chosen the winning teams and the number of required games of the fifteen (15) playoffs series for the 2018-2019 NHL season can win the prize referred to in these Rules. In the event that more than one participant has successfully chosen the winning teams of the fifteen (15) playoffs series for the 2018-2019 NHL season, the prize referred to herein will be equally divided among the winners.

6. PRIZE DESCRIPTION

The value of the sole Ultimate Challenge prize is the amount of five hundred thousand dollars ($500 000) in Canadian currency, which will be disbursed in a single (1) payment.

In the event that more than one participant has successfully chosen the winning teams and the number of required games of the fifteen (15) playoffs series for the 2018-2019 NHL season, the prize referred to herein will be divided equally among the winners.

By receiving the prize, the winner(s) acknowledge and accept the possibility that their winnings may be subject to taxes under the applicable tax laws.

7. CLAIMING THE PRIZE

To be declared a winner, every selected participant must:

  • Be contacted by the Organizer within ten (10) days following the last game of the playoffs of the 2018-2019 NHL season;
  • Correctly answer the mathematical skill-testing question that will be put to them, without help and within a specified time;
  • Accept the prize, as described in these Rules, which may not be transferred, changed or exchanged in any manner;
  • Abide by the conditions applicable to the prize and set out in these Official Rules; and
  • Submit a valid form of photo ID with their address and full name, on request.

In the event of the failure to abide by any of the terms and conditions set out in this section, or any other terms and conditions of the Official Rules, the selected person’s entry will be cancelled.

8. LIMITATIONS OF LIABILITY

All participants and/or winners release the Organizer, its promotional partners, the prize providers, their partners, affiliates, related companies, divisions and subsidiaries, and their advertising and promotional agencies, as well as their employees, agents and representatives, from any liability for any damages the participants may suffer as a result of the acceptance or use of their prize. To be declared a winner, and prior to obtaining their prize, every participant and/or winner undertakes to sign a Statement to this effect, where required.

9. VERIFICATION

The registrations and entries are subject to verification by the Organizer. Any entry or application which is incomplete, incomprehensible, inaudible, illegible, fraudulent, damaged, submitted late or otherwise not compliant, as the case may be, will be automatically rejected and will not entitle the participant to a prize.

10. NON-COMPLIANT ENTRY

The Organizer reserves the right to disqualify any person or cancel one or more entries of any person participating or attempting to participate in Ultimate Challenge by any means that is contrary to these Rules or in a manner that is unfair to the other participants, particularly, without limitation, by submitting entries in excess of the permitted limit, or through computer hacking.

Any such person may be required to answer for their actions to the competent legal authorities. Any attempt to deliberately interfere with the Website or harm the legitimate operations of Ultimate Challenge is a violation of the criminal and civil laws. Should such an attempt occur, the Organizer reserves the right to claim damages from such person, without prejudice to the Organizer’s rights to institute any other proceedings as permitted by law. Such a person may be referred to the competent legal authorities.

11. ACCEPTANCE OF PRIZE

Any prize must be accepted as described in these Rules and may not be transferred to any other person or substituted for another prize.

12. REFUSAL TO ACCEPT PRIZE

The refusal by a winner to accept a prize in accordance with the terms of these Rules releases the Organizer from any further obligation to such person with respect to that prize.

13. RESPONSIBILITY OF PRIZE PROVIDER

Every winner for a prize acknowledges, once they are confirmed as the Ultimate Challenge winner, that the prize provider becomes wholly and exclusively responsible for providing the services associated with the prize.

14. LIMITATION OF LIABILITY – FUNCTIONING OF CONTEST

The Organizer, its promotional partners, the prize provider, their affiliates, related companies, divisions and subsidiaries, and their advertising and promotional agents, as well as their employees, agents and representatives, disclaim any and all liability for the malfunctioning of any hardware, software or line of communication; for any deficient, incomplete, incomprehensible or deleted transmission by any computer or network; for any problems with the functions or features of the Website, regardless of the cause thereof; for any malfunction or damages caused to the network or telephone lines, computing equipment, voicemail system or device, data or software, online systems, servers or access providers; for any loss of functions due to non-active cookies; for any Internet congestion, breach of the security or confidentiality of information sent via the computing or telephone networks; and for any infringement of privacy or personal information as a result of interference by hackers; and which could restrict the opportunity of any person, or prevent them, from participating in Ultimate Challenge.

The Organizer, prize provider, their affiliates, related companies, divisions and subsidiaries, and their advertising and promotional agencies, as well as their employees, agents and representatives, also disclaim any liability for any damage or loss that could be caused, directly or indirectly, or in whole or in part, by the downloading of any software or any form, or by the transmission of any information relating to the participation in Ultimate Challenge.

The Organizer, prize provider, their affiliates, related companies, divisions and subsidiaries, and their advertising and promotional agencies, as well as their employees, agents and representatives, do not in any manner warrant that the Website and the application, as applicable, are accessible or functional without interruption for the Duration of Ultimate Challenge, or that they are error free.

15. MODIFICATION

The Organizer reserves the right, in its absolute discretion, to cancel, terminate, modify or suspend Ultimate Challenge, in whole or in part, should any event, error or human intervention occur that may corrupt or affect the administration, security, impartiality or operation of Ultimate Challenge, as contemplated in these Rules.

In any event, the Organizer, its affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, and the product and service providers of Ultimate Challenge, as well as their employees, agents and representatives, shall not be required to award more prizes than the specific prize indicated in these Rules, or to award a prize otherwise than in accordance with these Rules.

16. LIMITATION OF LIABILITY – PARTICIPATION

Every person participating or attempting to participate in Ultimate Challenge releases the Organizer, its promotional partners, affiliates, related companies, divisions and subsidiaries, and its advertising and/or promotional agencies, as well as their employees, agents and representatives, from any liability for any damage that such person may sustain as a result of their participation or attempted participation in Ultimate Challenge.

17. AUTHORIZATION

Any winner, by participating in Ultimate Challenge, authorizes the Organizer and its partners and representatives, in their absolute discretion, to use such winner’s name, photograph, image, prize statement, address of their place of residence and/or voice without any form of compensation in return, and without any limitation on the period of use thereof, in any media and throughout the world, for advertising purposes, or any other purpose they consider relevant.

18. COMMUNICATION

All participants, by registering for Ultimate Challenge, authorize the Organizer to communicate with them in connection with Ultimate Challenge, and for purposes of any other communications relating to the Fondation du Centre Normand-Léveillé.

19. ORGANIZER’S DECISIONS

Any decision by the Organizer or its representatives relating to Ultimate Challenge is final and without appeal. In the event that any paragraph of these Rules is declared or found to be illegal, unenforceable or null and void by a competent court, such paragraph shall be considered void, but all the other paragraphs that remain unaffected shall continue to apply, as permitted by law.

20. IDENTIFICATION OF PARTICIPANT

For the purposes of these Rules, the participant is the person whose contact information is recorded at the time of their registration via the Website. It is to this same person that the prize will be awarded in the event that they are selected and declared a winner.

21. RULES

These are the Official Rules of Ultimate Challenge. The rules of Ultimate Challenge are available, on request, from the Organizer and on the Website.

Ultimate Challenge is governed by the applicable laws and regulations of Canada and the province of Quebec, and any dispute arising therefrom shall be submitted to the courts of law of the province of Quebec.
